RICHMOND - Virginia Secretary of Health and Human Resources Dr. BillHazel announced today the establishment of a statewide health reform initiative. 

The intent of the Health Care Reform Initiative, which will be within the Health and Human Resources Secretariat, is to prepare Virginia for the implementation of federal health reform by planning for the expansion of Medicaid eligibility.  It is estimated that this expansion will increase the number of Medicaid enrollees in Virginia from 270,000 to 425,000, at a cost of $1.5 billion dollars between 2017 and 2022. There exists a pressing need for the Commonwealth to begin planning for the implementation of federal Health Care Reform, while also implementing other innovative healthcare solutions.  

Speaking about the Health Care Reform Initiative, Secretary Hazel remarked, "Expanding access to reasonably priced high quality and safe healthcare is a bipartisan goal. The Commonwealth must make it easier for Virginians to be healthier and to purchase and retain health insurance. Virginia is one of many states challenging the Patient Protection and Affordable Care Act and the Healthcare and Education Affordability Reconciliation Act.  However this lawsuit could take two to three years to be settled.  As we wait for court decisions, the Commonwealth must comply with the acts and begin preparing for implementation of federal health care reform."

Secretary Hazel continued, "In Virginia, we will work to provide incentives for health promotion and disease prevention and encourage individuals to remain healthy.  We will also encourage individuals to make informed decisions in purchasing healthcare by promoting consumer directed healthcare.  We will study our medical delivery systems with the objective of reforming them to work better for our citizens and ensuring that we have a strong healthcare workforce. We will be aggressive in finding every way to continue providing care to our most vulnerable citizens, while identifying ways by which we can reduce the cost of our Medicaid system, which has grown 1,600% in the past 25 years and is unsustainable in its current structure"

            Secretary Hazel also remarked, "The Health Reform Initiative will not be limited to federal health reform.  It will also pursue reforms to ensure a safe, effective, and high quality health care delivery system while reducing costs.  The Initiative will promote innovation, quality and cost-effectiveness within Virginia's health care delivery system and seek to reduce the regulatory burden on all Virginians."

Health Care Reform Initiative

            The Health Care Reform Initiative shall be established within the Office of the Secretary of Health and Human Resources.  The Health Care Reform Initiative will manage activities related to federal health care reform.  The Health Care Reform Initiative will serve as the liaison between the Governor's office, agencies and entities affected by health care reform, lead development of the required Health Insurance Exchange and identify and coordinate grants to fund health care reform.

            The Health Care Reform Initiative will consider the impact and requirements of the Patient Protection and Affordable Care Act, the Healthcare and Education Affordability Reconciliation Act, explore the current state of the Department of Medical Assistance Services, best practices for Medicaid programs across the nation, pursue other independent reforms to ensure a safe effective, and high quality health care delivery system while reducing costs, and will make findings and recommendations for addressing the following priorities:

1.      Medicaid Reform:

a.       Plan for the expansion of Medicaid to cover all Virginians under the age of 65 up to 133% of the Federal Poverty Level by 2014;

b.      Consider implementing best practices for Medicaid programs across the nation;

c.       Examine the audit, when completed, of the Department of Medical Assistance Services and recommend reforms and improvements to the Medicaid program; and

d.      Explore consumer driven reforms to Virginia's Medicaid program.

2.      Insurance Reform:

a.       Plan for the organization and creation of a Health Insurance Exchange for implementation in 2014;

b.      Prepare for required insurance reforms, including the requirements for guaranteed issue and renewability; prohibition on pre-existing conditions, rating bands that include age, family structure, geography, actuarial value and tobacco use;

c.       Examine alternatives to the required insurance reforms; and

d.      Explore avenues to improve competition among health insurers.

3.      Healthcare Delivery Reform:

a.       Propose reforms to Virginia's health care delivery system to make it more effective and efficient;

b.      Plan for implementation of near term and long term federal requirements for Health Care Reform;

e.       Evaluate Virginia's existing health care infrastructure to handle mandated federal programs;

f.       Determine existing resources in state government for implementation of Health Care Reform and gaps that need to be addressed;

g.      Examine timelines associated with federal legislation and ensure there is ample time to enact legislative and regulatory action to comply with federal deadlines for implementation;

h.      Address the current and anticipated health care workforce shortage;

i.        Develop a communications plan for stakeholders, the general public and state agencies on the effects of Health Care Reform;

j.        Propose market incentives to lower costs and improve efficiencies and effectiveness; and

k.      Reduce the regulatory burden on businesses and individuals.

            The Health Care Reform Initiative will set forth a comprehensive strategy for implementing health care reform.  The Health Care Reform Initiative will establish an advisory workgroup of stakeholders and interested parties to provide input and advice.  The membership of the advisory workgroup will be appointed by the Secretary of Health and Human Resources. 

            The Health Care Reform Initiative will submit to the Governor its findings and recommendations on matters potentially impacting the development of the Executive Budget no later than September 30, 2010.  The Health Care Reform Initiative will submit to the Governor reports of its activities, findings and recommendations no later than January 10, 2011, January 10, 2012, January 10, 2013, and a final report no later than January 10, 2014.

            The Health Care Reform Initiative will be funded from existing resources.  Staff support as necessary for the conduct of the Health Care Reform Initiative's work during the term of its existence will be provided by the Office of the Secretary of Health and Human Resources, the Department of Planning and Budget, the Department of Medical Assistance Services, and such other agencies as may be necessary with the approval of the Chief of Staff.

For First Time in Two Years, Virginia Posts Consecutive Months of Revenue Growth

Governor McDonnell Announces April General Fund Revenue Collections Increase by .4%; March Collections Increased by 3% RICHMOND- Governor Bob McDonnell announced today that Virginia has posted back to back months of revenue growth, marking the first time in two years the Commonwealth has achieved this result. The last time Virginia had back to back increases in monthly revenue collection was March-April 2008.  April 2010 revenue collections outpaced April 2009 by .4%. March 2010 revenue collections outpaced March 2009 by 3%. Corporate income tax posted a strong gain in April, +38.7%, and collections of sales and use taxes saw the highest monthly growth, +7.3%, since May 2008, excluding the one-time surge in sales tax collections in December 2009 that resulted from Virginia’s tax amnesty program.

Speaking about the April revenue numbers, Governor McDonnell remarked, “Although the increase in total revenue is modest, two consecutive months of growth represents a significant improvement in the trend for general fund revenue collections. Today’s news can be seen as a small indicator that some positive developments are taking place in our overall economy. However, we have a long way to go before we emerge from one of the deepest and most persistent economic downturns in our history. Unemployment is far too high, and Virginians are struggling to make ends meet, provide for their families and manage their businesses. We will continue to focus on putting in place pro-growth policies that encourage job creation and help get Virginia’s economy firmly back on track.”

Governor McDonnell Announces $492.7 Million Transportation Bond Sale

-Bonds Will Fund Road and Rail Projects-

RICHMOND - The Commonwealth Transportation Board today sold $492.7 million of Transportation Capital Projects Revenue Bonds to advance transportation projects managed by the Virginia Department of Transportation and the Virginia Department of Rail and Public Transportation.

 The bonds were sold through competitive bidding. Seven underwriters submitted bids on the bonds. Goldman Sachs and Co. had the winning bid with a true interest cost of 3.247 percent. The bonds were rated AA+ by Fitch and Standard and Poor’s, and Aa1 by Moody’s.

The bond funding will be combined with other state and federal dollars to keep highway, rail and transit projects moving forward when the Commonwealth updates its Fiscal Years 2011-2016 Six-Year Improvement Program this spring.

The bond sale, recently approved by Governor Bob McDonnell, is the first issuance of the Transportation Capital Projects Revenue Bonds that were authorized by the Virginia General Assembly in 2007.

“Although our financial challenges and transportation necessities continue, this is a tangible example of how the Commonwealth is making positive strides by maximizing funding options for our roads, bridges, rails and public transportation,” McDonnell said.

“Issuing these bonds will permit the completion of projects under way and will allow Virginia to start new project phases in accordance with our Six-Year Transportation Improvement Program,” said Secretary of Transportation Sean Connaughton.  “Virginia’s transportation system needs more funding to address the backlog of maintenance and construction on our transportation system. But, taxpayers must to be confident that we are using all available financing tools before we ask them to make additional investments in highways and rails. This bond issue is a step in restoring confidence in the integrity of Virginia's transportation finance program.”

Governor McDonnell Approves Nearly $500 Million in Transportation Bonds

Planned Bond Sales to Fund Road and Rail Projects

RICHMOND - Governor Bob McDonnell approved the sale of nearly $500 million in bonds to advance transportation projects managed by the Virginia Department of Transportation (VDOT) and the Virginia Department of Rail and Public Transportation (DRPT) today.  The bonds are scheduled to be sold in May 2010. 

In addition, the governor has directed VDOT to sell $293 million of bonds in fiscal year 2011 and another $300 million in each fiscal year from 2012 through 2016 as part of the commonwealth’s Six-Year Improvement Program. 

Speaking about the approval, Governor McDonnell remarked, “When the General Assembly authorized these bonds as part of the 2007 transportation package called House Bill 3202, they expected the Commonwealth to use this funding to advance projects and, as promised, I am doing exactly that.  In these difficult economic times and with our mounting transportation needs in the Commonwealth, it is important to use every tool available to maximize funding options for our roads, bridges, rails, and public transportation.  Our plan is to issue $2.2 billion in these bonds over the next six years.”

Secretary of Transportation Sean Connaughton noted, “The issuance of these bonds will permit the completion of projects underway and to start new project phases in accordance with the State’s Six Year Transportation Plan.  This bond issue is a step in restoring confidence in the integrity of Virginia’s transportation finance program.”

Virginia Speaker of the House Bill Howell, who sponsored HB3202, commented, “In 2007 we passed important legislation to fund transportation projects.  Virginia’s transportation system is in need of more funding to get projects going and cars on our highways moving again.  I am pleased that Governor McDonnell understands how important this is and has issued these bonds to fund our state’s priority transportation projects.”

The bond funding will be combined with other state and federal dollars to continue moving projects forward when the Commonwealth updates its Fiscal Years 2011-2016 Six-Year Improvement Program this spring.  The bond funding is helping to advance projects around the state, such as:

  • Interstate 81 truck-climbing lanes (Staunton and Salem districts)
  • Lynnhaven Interchange on I-264 (Hampton Roads District)
  • Route 29 Gainesville Interchange on I-66 (Northern Virginia District)
  • Eleven bridge rehabilitations on I -95 (Richmond District)
  • Route 460 Connector (Bristol District)
  • Building a new interchange on Route 15 at Route 17 (Culpeper District)
  • Reconstruction of Route 610 (Fredericksburg District)
  • Route 265 Franklin Turnpike Connector (Lynchburg District)
  • Dulles Metrorail
  • Norfolk Light Rail

 Yesterday the bonds received a rating of Aa1 from Moody’s, AA+ from Fitch and AA+ from Standard and Poors.

Governor McDonnell Highlights Legislation Focused on Making Virginia America’s MostVeteran-Friendly State

Governor Proclaims May ‘Crown Royal Heath Calhoun 400 Month’; Hosts Iraq War Veteran and Paralympics Athlete at Executive Mansion in Celebration of Accomplishments

 RICHMOND - In a ceremonial signing ceremony, Governor Bob McDonnell today highlighted 27 pieces of legislation, signaling his commitment to make Virginia the most veteran-friendly state in America.  The Governor was joined on the South Portico of the Virginia Capitol by Paul Galanti, Commissioner of the Department of Veterans Services, Major General Bob Newman, Commander of the National Guard, and Delegate Kirk Cox (R-Colonial Heights), as well as other bill patrons and veterans.  The Governor served 21 years active duty and reserve in the U.S. Army, retiring as a Lieutenant Colonel in 1997.  His oldest daughter, Jeanine, also served in the Army, including a one-year tour of duty in Iraq.

Earlier today, Governor McDonnell hosted Iraq War Veteran and Paralympics athlete, Heath Calhoun, at the Executive Mansion in celebration of this weekend’s Sprint Cup Series race at Richmond International Raceway, which will carry his name.  

Speaking about the legislation, Governor McDonnell commented, “In 1789, George Washington said, ‘The willingness with which our young people are likely to serve in any war, no matter how justified, shall be directly proportional to how they perceive veterans of early wars were treated and appreciated by our nation.’ The same holds true today—the more than 830,000 veterans who call Virginia home deserve the absolute best.  They have put their lives on the line abroad for our freedom here at home and I intend to make Virginia the most veteran-friendly state in the country.  As promised during the campaign, I have directed the Commissioner of the Department of Veterans to develop a Veterans Bill of Rights.  By working with veterans groups, Commissioner Galanti will identify the needs of veterans and their families and ensure that those needs are met.” 

 The Governor continued, “This tough economy has had a significant impact on veterans. I’ve asked the Virginia Employment Commission, in cooperation with the Department of Veterans Services and the Secretary of Commerce and Trade, to establish the Veterans Skills Database.  Free to both veterans and employers, this database will help market and promote the workforce skills of our veterans.  In an effort to return more money to their pocketbooks, I support the state constitutional amendment to provide real estate tax exemption for veterans with 100% service-connected disability.  In addition, when applying for a small business permit through the one-stop business permitting program, we will waive certain fees for veterans giving them a greater opportunity to positively impact our economy.” 

Governor McDonnell also noted, “The American flag is a symbol of our freedom and democracy.  There is bipartisan consensus to protect a Virginian’s right to fly the American flag on his/her property.  In addition, I am designating the Honor and Remember Flag as the Commonwealth's emblem of service and sacrifice by the brave men and women of the United States Armed Forces, who have given their lives in the line of duty.  Three of our most recent wars, the Global War on Terrorism, Operation Enduring Freedom, and Operation Iraqi Freedom, will now be recognized on Veterans Day and Memorial Day.  It is important to remember and honor all of our veterans, as well as those who gave the ultimate sacrifice.”

Finally, the Governor concluded, “All of the legislation recognized today will take us a step further and ensure our veterans are receiving our gratitude and thanks when they return home.  I thank all the patrons for their acknowledgement of the great sacrifice our veterans have made.  The overwhelming bipartisan support of our veterans strikes the right tone that I look to build upon.  I look forward to working with our veterans and their families during my administration so we can make Virginia the best state in America for veterans.”

 Attorney General Ken Cuccinelli, who was unable to attend the event added, “The passage of these bills fulfilled a vow we made to our military men and women:  That we would amend Virginia's election laws to guarantee the timely delivery of ballots to military members overseas, so that those ballots were guaranteed to be counted – and our soldiers’ voices would be heard – in every election.”  Attorney General Cuccinelli drafted and advanced HB 55 and SB 1235 through the General Assembly this session. 

A prisoner of War in Vietnam, Commissioner Galanti said, “It’s an honor to be able to continue to work with our veterans in this capacity.  I know the Governor is extremely dedicated to this cause and I am eager to see it through. This legislation being signed today will further the goals and initiatives of this administration and I look forward to building upon them.”

Kirk Cox (R-Colonial Heights), concluded the event by saying, “I was proud to carry a number of veteran initiatives through the General Assembly this session.  The Wounded Warrior program will now be expanded to cover mental health and rehabilitative services for Virginia veterans with stress-related injuries and traumatic brain injuries resulting from military service. Anyway that we can show our appreciation and give back to our veterans who gave so much to us is worth our time and our efforts.”  

Earlier today, the Governor proclaimed the month of May ‘Crown Royal Heath Calhoun 400 Month’ in honor of Mr. Calhoun’s accomplishments.  An Iraq War Veteran and Paralympics athlete, Heath Calhoun, is the winner of this year’s Crown Royal® “Your Name Here” contest—the race is officially titled “Crown Royal Presents The Heath Calhoun 400.”  Mr. Calhoun retired from the US Army when he lost both of his legs in an explosion in Iraq; he was awarded a Purple Heart, as well as the George C. Lang Award for Courage.  He has generously volunteered his time with the Wounded Warrior Project.  This past winter, Mr. Calhoun came in 8th place in the Super-G and 10th place in the Men’s Super Combined alpine skiing events during the 2010 Paralympics Winter Games. He was selected by Team USA to serve as flag bearer for Opening Ceremonies in Vancouver during the Winter Games.

  • Provides burial vaults at cost to eligible veterans and their family members interred at state-operated veterans cemeteries, based on available funding at the Department of Veterans Services.

Free fishing licenses to disabled, active duty military personnel (HB128)(Cox)

  • Authorizes the Department of Game and Inland Fisheries to issue free fishing licenses to disabled, active duty military personnel who are receiving inpatient or outpatient medical treatment from a veterans or military hospital in Virginia, an adjoining state, or the District of Columbia.

Fishing license; exempts active duty military personnel who are residents (SB243) (Watkins)

  • Exempts active duty military personnel who are residents and on leave from having to obtain a basic fishing license so long as they can show proof that they are on leave.

Condominium and Property Owners' Association Acts; display of U.S. flag (HB956 / SB151)_(Lingamfelter/Stuart)

  • Provides that a unit owners' or property owner's association shall not prohibit or otherwise adopt or enforce any policy restricting a unit or lot owner from displaying upon property to which that owner has a separate ownership interest or a right to exclusive possession or use the flag of the United States whenever such display is in compliance with the federal Flag Code. The bill also provides that the unit owners' or property owners' association may establish reasonable restrictions as to the size, place, duration, and manner of placement or display of the flag provided the restrictions are necessary to protect a substantial interest of the unit owners' or property owners' association. Under the bill in an action brought to enforce a rule pertaining to display of the flag, the unit owners' or property owners' association has the burden of proof regarding whether the rule protects a substantial interest of the association.

Adds Global War on Terrorism, etc., to wars that are honored (HB1226)(Tyler)

  • Adds the Global War on Terror, Operation Enduring Freedom, and Operation Iraqi Freedom to the wars that are recognized on Veterans Day and Memorial Day. The bill also adds the Global War on Terror and Operation Enduring Freedom to the wars or conflicts for which a locality may issue permits for the erection of monuments or memorials.

Absentee ballots; procedure for various deadlines and ballot requirements (SB55 / HB1235)_(Martin/Anderson)

  • Requires that ballots be prepared and available for absentee voting not later than 45 days before any election rather than 45 days before the November election and 30 days before other elections.  The bill also requires preparation of ballots 45 days in advance of special elections for federal office and allows, if necessary, preparation as soon after that deadline as possible for other special elections.  Various deadlines for nominations and filings are adjusted in response to the ballot preparation change. 

Reemployment rights of members Virginia National Guard, State Defense Force, or naval militia (SB349) (Hanger)

  • Extends the period in which a member of the Virginia National Guard, Virginia State Defense Force, or naval militia is required to apply for reinstatement in his former job to 90 days following his release from duty or from hospitalization following release, if the length of the member's absence by reason of service in the uniformed services exceeds 180 days. If the duration of his absence does not exceed 180 days, such notice must be given within 14 days, which is the current period allowed in all instances regardless of the duration of the absence. This notice period is consistent with that provided under the federal Uniformed Services Employment and Reemployment Rights Act for service members deployed for 181 days or longer.

Insurance of Virginia National Guard if called to active duty by Governor (HB1233 / SB613)__ (Miller, Paula/Wampler)

  • Allows a member of the Virginia National Guard called to state active duty by the Governor to continue his health care coverage, life insurance and long-term care insurance, at the member's expense.

HOV lanes; allows certain military personnel to use in Hampton Roads regardless of passengers  (HB759/SB696) (Stolle and Villanueva /McWaters)

  • Allows any active duty military member in uniform to use HOV lanes, regardless of the number of passengers, on Interstate Route 264 and Interstate Route 64 for the purposes of traveling to or from a military facility in the Hampton Roads Planning District.

Exemption of handling fee for veterans opening small business (HB 262/SB 455) (Sherwood/Greason & Hurt/Stosch)

  • Exempts veterans from paying the Department of Business Assistance's handling fee when establishing a small business through the one-stop small business permitting program.

Honor and Remember Flag; State's emblem of service and sacrifice by members of U.S. Armed Forces (HJ137)___ (Cosgrove, Sherwood, Hurt)

  • Designates the Honor and Remember Flag as the Commonwealth's emblem of service and sacrifice by the brave men and women of the United States Armed Forces who have given their lives in the line of duty.

 Constitutional amendment; property tax exemption for certain veterans (HB149/SB31) (O’Bannon/Puller)

  • Provides for a referendum at the November 2, 2010, election to approve or reject an amendment requiring the General Assembly to provide a real property tax exemption for the principal residence of a veteran, or his or her surviving spouse, if the veteran has a 100 percent service-connected, permanent, and total disability.

 Veterans Bill of Rights (HB 1337)_______________ (Lingamfelter)

  • Requires the Commissioner, in conjunction with the Board of Veterans Services, to establish and implement a compact with Virginia's veterans, which shall have a goal of making Virginia America's most veteran-friendly state.  The bill specifies the provisions to be contained in the compact, and requires the Commissioner to include the status and progress of the compact in his annual report.

 Interstate Compact on Educational Opportunity for Military Children (SB 299) (J Miller)

  • Requires the Department of Education to employ a military family education liaison to provide staff support for the Virginia Council on the Interstate Compact on Educational Opportunity for Military Children and to assist military families and the state in facilitating the implementation of the Interstate Compact

 Electronic processing of disability claims (HB 419)_________ (K Cox)

  • Requires the Department of Veterans Services to replace its existing case management technology, which replacement is required to support highly sophisticated electronic claims preparation.

Eliminates requirement that Wounded Warrior Program cover only combat injuries (HB 174) (K Cox)

  • Eliminates the requirement that the Wounded Warrior Program cover only injuries sustained by military service personnel in combat areas.

Virginia Military Family Relief Fund (HB 1118/SB 619)___ (Stolle/Herring)

  • Allows individuals who receive payments from the Virginia Military Family Relief Fund to subtract them from their federal adjustable gross income when calculating their Virginia taxable income, for taxable years beginning on and after January 1, 2010.

Veterans Skills Database  (HB 760)___________________________ (Stolle)

  • Requires the Virginia Employment Commission, in cooperation with the Department of Veterans Services and the Secretary of Commerce and Trade, to establish the Veterans Skills Database, an Internet-accessible database of veterans and their workforce skills, for the purpose of marketing and promoting the workforce skills of veterans to potential employers. The database will be free to both veterans and employers.

 Burial power of attorney (HB 382) ____________________ (Sherwood)

  • Provides that when a person dies while on active military duty and has designated an individual to make arrangements for his funeral and disposition of his remains on a U.S. Department of Defense Record of Emergency Data, the designee shall be responsible for making such arrangements.

Veterans Services Fund (SB 297)___________________ (J. Miller)

  • Provides that moneys in the Veterans Services Fund shall be administered by the Veterans Services Foundation to provide funding for veterans services and programs in the Commonwealth.

Attorney General Cuccinelli issues official opinion on E-cigarette

Electronic cigarette does not violate the Indoor Clean Air Act

CENTRAL VA –At the request of a resident of the 97th District, Delegate Christopher K. Peace (R-Hanover) recently asked for a formal written opinion from Attorney General Kenneth T. Cuccinelli, II in reference to the use of electronic cigarettes. 

An electronic cigarette, known as an e-cig, is a battery operated nicotine delivery system.  The device is used as an alternative to smoked tobacco products.  The nicotine vapor emitted provides users with a similar experience of lighted cigarettes without the combustion and smoke associated with smoked tobacco products. 

The AG’s opinion states: “an e-cigarette does not involve the “inhaling, or exhaling of smoke.” Smoke is defined as “the gaseous products of burning carbonaceous materials made visible by the presence of small particles of carbon.” To be sure, one definition of smoke is “fume or vapor often resulting from the action of heat on moisture.”  That, however, is not the way the term smoke is commonly understood.  Statutes should be construed under their “ordinary and plain meaning.”  Water vapor containing traces of particulate matter, such as water evaporating from a tea kettle, is not ordinarily understood to be “smoke.”  

Additionally the opinion reads: “An e-cigarette does not function in manner of a traditional cigarette because it functions electrically rather than via combustion of a material such as tobacco.  Therefore, the vapor emitted by an e-cigarette would not fall within the definition of “smoke” or “smoking” in Virginia Code 15.2-2820.  Second, an e-cigarette is battery powered and is not “lighted” as that term is commonly understood.  No flame is involved in its operation.” 

Speaking to the recent opinion Peace stated, "Logically if the purpose of the smoking ban was to create a healthier atmosphere in public places across the Commonwealth and reduce second hand smoke emissions, the e-cigarette does not seem to fit the parameters.”

“One positive outcome of e-cigs is that many users express the product has helped them reduce or eliminate the use of tobacco cigarettes.  These actions will result in healthier outcomes, increased quality of life and a reduction in medical expenses for these citizens,” Peace further asserted.

RICHMOND – Governor Bob McDonnell today announced a major initiative by his Administration aimed at reducing homelessness and expanding affordable housing in the Commonwealth. While touring the Better Housing Coalition’s Lincoln Mews apartments this morning, Governor Bob McDonnell announced the establishment of Virginia’s first executive housing policy framework, which will help guide the development of a housing policy to be announced in the fall.  The Governor’s policy will address homelessness and expanding affordable housing, as well as workforce housing, economic development, healthy neighborhoods, effective coordination of transportation, environmental issues and other opportunities.  The Governor intends to memorialize the housing policy framework in the next week.

Additionally, the Governor announced the formation of the Housing Policy Advisory Committee, chaired by Bob Sledd, Senior Economic Advisor to the Governor.  Sledd has extensive experience with non-profit housing organizations, including the Better Housing Coalition, and unique understanding of economic issues relating to the housing industry.

Speaking from Lincoln Mews, Governor McDonnell commented, “Affordable and safe housing is a fundamental component of healthy and prosperous communities.  Every Virginian deserves a safe, warm and secure residence to call their own. In this tough economy it is harder than ever for many to attain this basic necessity. Not only does this impact the quality of life of Virginians, housing also has direct implications for economic development, transportation, and the environment.  Therefore, today I am announcing the establishment of the Commonwealth’s first executive housing policy framework, which will be used as a guide to establish our official housing policy which will be announced in the fall.  The framework establishes goals and policy direction, and will lead to further coordination in matters affecting housing throughout executive branch agencies.”

The Governor continued, “I am also announcing a Housing Policy Advisory Committee to help guide our Administration in this comprehensive effort. In selecting a leader to chair the new advisory committee, I could think of no one more experienced in this field than Bob Sledd.  Bob has over a decade of experience working with non-profit housing organizations such as the Better Housing Coalition, and Homeward, Richmond’s regional homeless services coordinator.  He is dedicated to ensuring Virginia’s economic viability and knows that a key component is a successful housing policy resulting in thriving communities. Bob is passionate about this issue, and I thank him for taking on this additional responsibility in our administration.” 

Bob Sledd also remarked, “I have seen how integral housing is to the overall well-being of our fellow Virginians, and to our communities and our economy.  We hope to bring the insights of state agencies, communities and the private and nonprofit sectors together in development of this new policy, guiding future legislation and providing a framework for addressing housing needs throughout the Commonwealth.”

The policy framework will focus on recognizing the role housing policies play in economic development, creating healthy communities and encouraging energy efficiency.  The policy framework will also focus on the changing demographics of Virginia’s population and on increasing the capacity to address the needs of homeless Virginians.  The goal of the framework is to guide decision-making and bring coordination in matters affecting housing throughout executive branch agencies.

The Housing Policy Advisory Committee will be comprised of representatives from state government, private industry groups, local governments, and nonprofit housing providers and consumer representatives.

Peace joins Governor at signing of Civil War Preservation Bill

Preservation is consistent with the public interest in education, recreation and heritage tourism

Central Virginia – On Tuesday, at the Historic Wagner Farm in Chancellorsville, Virginia, Delegate Christopher K. Peace (R-Hanover) joined Governor Bob McDonnell, Speaker William J. Howell (R-Stafford) and nearly 200 observers as McDonnell signed House Bill 717 into law.  HB 717 patroned by Peace establishes in the Code of Virginia a vehicle to pursue Civil War site preservation in the Commonwealth in advance of the state’s 2011 Sesquicentennial commemoration.

"We must continue to work to celebrate Virginia’s rich history and heritage.  My district is home to the Battle of Cold Harbor, which is one of the most endangered sites in America.  The state should work with individuals and non-profits to see that our past is preserved for future generations.We must work and find opportunities for preserving and interpreting these valuable resources," stated Peace.

The Virginia Civil War Site Preservation Fund has existed only in budget language since it was created with strong bipartisan support in 2007.  The bill would retain oversight and grant award authority with the Director of the Virginia Department of Historic Resources.  Since its inception, with over $5 million 2,000 acres of historic battlefields have been protected in perpetuity.

Enactment of this measure creates the Fund as a non-reverting fund into which state general funds will be added only if specifically appropriated by the General Assembly.  No state funds are being requested at this time; rather, the primary sources of the funds are anticipated to be from grants or awards from the United States Government and from public and private gifts and bequests.  The Fund will make awards to private non-profit organizations or to state or local government agencies.

Funds will be used for purchase of protective interests in those Virginia Civil War battlefield historic sites recognized by the National Park Service's American Battlefield Protection Program.

"Virginia is poised to capitalize on enhanced revenue generated through these protection measures. The civil war tourist spends more and stays longer according to studies.  Tourism is beneficial to communities across the Commonwealth,” said Peace.  In Virginia, tourism marketing historically returns $5 in tax revenue to state and local coffers for every dollar spent in the same fiscal year.  That $5 generally breaks down into $2.88 in state tax revenues and $2.12 in local tax revenues.”

Additionally the travel industry in Virginia in 2008 generated $18.7 billion in visitor spending; supported 210,000 jobs; provided $1.2 billion in state and local taxes for Virginia's communities and $4.3 billion in payroll and salaries for local, state and federal economies.

VITA Improvements

Dear Fellow State Employee: Good afternoon. I wanted to take a moment on behalf of the Governor to let you know about today’s announcement that promised changes at VITA have been completed. Let me begin by saying that we have heard and understand the many concerns raised that VITA and Northrop Grumman must be focused on its mission of better serving the technology needs of Virginia’s state workforce. Since taking office, Governor McDonnell has taken three significant steps in fulfilling his promise and our goal of an improved VITA that is directly accountable to all of us.

The first step was legislation that has now passed and been signed into law that puts VITA under the direct control and authority of the Governor. That is important as necessary changes can now be implemented more quickly and effectively. The second was appointing a new Secretary of Technology and VITA CIO to help instill a new direction for the agency. Secretary of Technology Jim Duffey has significant experience in the private sector managing IT operations. Additionally, the appointment of former Delegate Sam Nixon, a career IT professional and longtime public servant, brings real-world experience of the industry and an understanding of the issues that have confronted state employees in the past. Finally, the Commonwealth has entered into a substantial modification of the contract with Northrop Grumman which provides for significant performance improvements and operational efficiencies by the vendor. These include the creation of a rapid response team with additional onsite resources and abilities to quickly resolve individual IT issues. Also overhauling the VITA Help Desk will provide other improvements that are critical to keeping you operating at maximum efficiency such as resetting a password within one hour.

It is a new and improved VITA with much more accountability and responsiveness from Northrop Grumman that we believe will better serve you in your efforts to serve the citizens of Virginia. One of the primary duties of Sam Nixon is to ensure that customer service is a top priority. Finally, both the Governor and I are personally committed to making this a success. We ask for your continued patience and constructive feedback as we proceed forward.

Governor issues Confederate History Month Proclamation

WHEREAS,  April is the month in which the people of Virginia joined the Confederate States of America in a four year war between the states for independence that concluded at Appomattox Courthouse; and WHEREAS,  Virginia has long recognized her Confederate history, the numerous civil war battlefields that mark every  region of the state, the leaders and individuals in the Army, Navy and at home who fought for their homes and communities and Commonwealth in a time very different than ours today; and

WHEREAS,  it is important for all Virginians to reflect upon our Commonwealth’s  shared history, to understand the sacrifices of the Confederate leaders, soldiers and citizens during the period of the Civil War, and to recognize how our history has led to our present; and

WHEREAS, Confederate historical sites such as the White House of the Confederacy are open for people to visit in Richmond today, and

WHEREAS, all Virginians can appreciate the fact that when ultimately overwhelmed by the insurmountable numbers and resources of the Union Army, the surviving, imprisoned and injured Confederate soldiers gave their word and allegiance to the United States of America, and returned to their homes and families to rebuild their communities in peace, following the instruction of General Robert E. Lee of Virginia, who wrote that, “...all should unite in honest efforts to obliterate the effects of war and to restore the blessings of peace."; and

WHEREAS,   this defining chapter in Virginia’s history should not be forgotten, but instead should be studied, understood and remembered by all Virginians, both in the context of the time in which it took place, but also in the context of the time in which we live, and this study and remembrance takes on particular importance as the Commonwealth prepares to welcome the nation and the world to visit Virginia for the Sesquicentennial Anniversary of the Civil War, a four-year period in which the exploration of our history can benefit all;

NOW, THEREFORE, I, Robert McDonnell, do hereby recognize April 2010 as CONFEDERATE HISTORY MONTH in our COMMONWEALTH OF VIRGINIA, and I call this observance to the attention of all our citizens.

Peace attends Groundbreaking for Natural Gas Line

CENTRAL VA – Delegate Christopher K. Peace (R-Hanover) today joined Lieutenant Governor Bill Bolling and officials from King William County, Nestlé Purina PetCare Company and Virginia Natural Gas to celebrate a 12-mile natural gasline project along U.S. Route 360.

Discussions concerning this project began in the Spring of 2008; Delegate Peace was an integral part of the planning and development process for this endeavor. A check in the amount of $63,200 for job training from the Virginia Jobs Investment Program was presented by Peace to Mike Broz, of Nestlé Purina PetCare Company.

Speaking to the project, Peace asserted, “Extension of natural gas service along this corridor will immediately impact two industrial parks and position the rapidly growing county to attract new businesses spurring continued economic development.”

He continued, "In these difficult economic times it is important to be supportive of ventures which will generate revenue to aid localities in the provision of needed services for residents.”

Bit by Bit: Off-Shore Exploration Gets Major Boost

CENTRAL VA - In September of 2008, Congress lifted the federal moratoria on offshore exploration providing for a tremendous opportunity for the Commonwealth to begin investments that will reduce reliance on foreign sources of energy, while also helping to strengthen our economy.  These opportunities met bi-partisan support during the 2010 General Assembly session. Passed by a vote of 69-28 in the House and 32-8 in the Senate, House Bill 787 was signed into law by Governor McDonnell on March 10 of this year.  Delegate Christopher K. Peace (R-Hanover) was delighted to co-patron HB 787.  Passage of this measure makes it the policy of the Commonwealth to support oil and natural gas exploration, development, and production 50 miles or more off of the coast of Virginia.

Prior to Session, Del. Peace wrote Ken Salazar, U.S. Secretary of the Interior, to support the development of energy resources off the coast of Virginia. The text of this letter is enclosed.  A study by ICF International estimates that developing Virginia's offshore energy resources could result in nearly $19.5 billion in federal, state, and local government revenues.  The collective pressure from Del. Peace and his colleagues has paid off.  President Barrack Obama now plans to unveil new drilling policy today designed to create jobs and reduce the nation's addiction to foreign oil imports.

Delegate Peace contends, "The development of Virginia's offshore energy reserves would mean thousands of new jobs and hundreds of millions in tax revenue.  It is vital in the economic times that legislators take steps to create jobs and implement revenue generating policies." "This action brings with it tremendous opportunity for our Commonwealth to begin investments that will reduce reliance on foreign sources of energy, while also helping to strengthen our economy."

A recent study on the issue, produced in 2005 by a professor at Old Dominion University, estimated that offshore natural gas production off of the Virginia coast would, over a 10-year period, likely create 2,578 new jobs, induce capital investment of $7.84 billion, yield $644 million in direct and indirect payroll, and result in $271 million in state and local taxes.  The numbers were based on a conservative projection of the possible cubic feet of natural gas existing in the targeted area offshore.

Governor Bob McDonnell fulfilled one of his campaign pledges to help us move toward energy independence and create jobs to get our economy moving again by signing House Bill 787.  Governor McDonnell also signed an additional energy measure into law.  House Bill 756 will require that all revenues and royalties paid to the Commonwealth as a result of offshore natural gas and oil drilling be allocated as follows: 70 percent to the Transportation Trust Fund, 20 percent to the Virginia Coastal Energy Research Consortium, and 10 percent to localities for improvements to infrastructure and transportation.

As a Virginian and member of the House of Delegates, I would like to express my support for the development of energy resources off the coast of Virginia and the pending Sale 220 scheduled for 2011.

A study by ICF International estimates that developing Virginia's offshore energy resources could result in nearly $19.5 billion in federal, state, and local government revenues.  In these challenging fiscal times, the economic impact of the Lease Sale cannot be downplayed.  Delaying the opportunity for Virginians to benefit from the development of oil and natural gas resources would subsequently delay the opportunity to bring critical jobs to Virginia, and threaten the potential for future revenue sources.

Last year, I was pleased to see Congress lift the federal moratoria on offshore exploration. This action brings with it tremendous opportunity for our nation to begin investments that will reduce reliance on foreign sources of energy, while also helping to strengthen our economy.

I support the safe exploration of offshore energy resources, and urge your office to see Virginia Lease Sale 220 through on schedule.
